These Terms & Conditions govern your use of the www.yogainnerpeace.com Website (the “Website”), or any services (e.g. yoga classes, meditation classes, breathing control techniques, workshops, retreats etc) provided in connection with the Website (the “Service”), and your relationship with Yoga Inner Peace (“Yoga Inner Peace”, “we” or “us”). Please take a moment to carefully read as they affect your rights and liabilities under the UK law.
You agree that by accessing or using the Website or any services provided in connection with the Website, you are at least 18 years old and that you are legally able to enter into this agreement.
1.0 Use of the Website
By accessing or using the www.yogainnerpeace.com Website (the “Website”) or any Services including but not limited to classes, sessions, workshops, retreats provided in connection with the Website (the “Service”), you are agreeing to be bound by these Terms & Conditions (which may be amended by us from time to time, without any notice), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local and international laws.
Your right to access and use the Website will terminate immediately, without any further action by us, if you breach these Terms & Conditions or we otherwise in our reasonable discretion determine that you are causing harm to the Website, yourself or any other party. By using the Website, you are agreeing to be bound by the current version of these Terms & Conditions.
Yoga Inner Peace may, in its sole discretion and without prior notice, (a) revise these Terms & Conditions; (b) modify the Website and/or the Service; and/or (c) discontinue the Website and/or Service at any time. Yoga Inner Peace shall post any revision to these Terms & Conditions to the Website, and the revision shall be effective immediately on such posting. It is your responsibility, and you agree to review these Terms & Conditions and other online policies posted on the Website periodically to be aware of any revisions. You agree that, by continuing to use or access the Website and/or Services following notice of any revision, you shall abide by any such revision and if at any time you find these Terms & Conditions unacceptable, you must immediately leave the Website and cease all use of the Service and the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms & Conditions.
You must ensure that the details provided by you on registration or request to book a Service (e.g. class, session, workshop, retreat) at any time are correct and complete. You may not misrepresent your identity for any purpose whatsoever. You must inform us immediately of any changes to the information that you provided to us by emailing us the changes. You should never allow other parties to use the Services you paid for your personal use. You may be held liable for any losses incurred by the Yoga Inner Peace, its affiliates, officers, directors, employees, consultants, agents, and representatives due to providing inaccurate information for yourself and/or allowing someone else to use the Services you paid for your personal use.
2.0 Compliance with Intellectual Property Laws
The content of the Website is owned solely by Yoga Inner Peace and it is protected by copyright, trademark law, database right and other intellectual property rights. The Website can only be used for your personal and non-commercial use. You may only use the Website in the way the content you access is intended and in compliance with these Terms & Conditions and with any and all applicable laws, rules and regulations. You may not reproduce, modify, copy, transmit, display, perform, sell or otherwise distribute any information or content, products or services contained within the Website.
3.0 Prohibited Uses:
You are prohibited from violating or attempting to violate any security features of the Website or Service, including, without limitation, (a) accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access; (b) attempting to probe, scan, or test the vulnerability of the Service, the Website, or any associated system or network, or to breach security or authentication measures without proper authorization; (c) interfering or attempting to interfere with service to any user, host, or network, including, without limitation, by means of submitting a virus to the Website or Service, overloading, “flooding,” “spamming,” “mail bombing,” or “crashing;” (d) using the Website or Service to send unsolicited e-mail, including, without limitation, promotions, or advertisements for products or services; (e) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws; (f) transmitting material that encourages conduct that constitutes a criminal offense, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice; (g) interfering with any other person’s use or enjoyment of the Website; or (j) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner. Any violation of system or network security may subject you to civil and/or criminal liability. You will be responsible for our losses and costs resulting from your breach of this clause.
4.0 Waivers to Specific Issues
4.1 Liability
The Website might provide content from other Internet Sites or resources and while we try to ensure that material included on the Website is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If we are informed of any inaccuracies in the material on the Website, we will attempt to correct the inaccuracies as soon as we reasonably can. Yoga Inner Peace will take any reasonable measure to ensure the content of third parties displayed on our website is correct and valid at the time of publishing, however, Yoga Inner Peace cannot be held responsible for the accuracy or effectiveness of the information shown from third parties into our website.
If we are in breach of the Yoga Inner Peace Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order. We shall not be liable to you for damages of any kind, including but not limited to special, incidental, indirect or consequential damages, lost data, lost profits, damage to profits, income, revenue or business interruption, regardless of the foreseeability of those damages, arising out or in connection with your use of the Website, Services or any other material provided to you by the Yoga Inner Peace. You assume the risk of any and all damage or loss from use of, or inability to use, the Website or the Service and you agree to take full responsibility.
This clause shall not limit or affect our liability resulting from any Services sold through the Website and/or provided to you by the Yoga Inner Peace being found to be unsafe or if something we do negligently causes death or personal injury. Yoga Inner Peace will not be liable to you in respect of any personal injury (including without limitation serious injury or death) that you may suffer or sustain directly or indirectly as a result of attending any Service.
Although we aim to allow the best possible access to the Website and associated services, Yoga Inner Peace does not warrant that the Website and/or the Services will meet your requirements, or the Service will be uninterrupted or error-free. If a fault occurs in the service, you should report it to info@yogainnerpeace.com and we will attempt to correct the fault as soon as we reasonably can.
Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
Please note that you cannot use the above issues with accessing the Website and our Services to require any discount or free services from us at any time.
4.2 Disclaimer & Health Warranty
The materials on the Website and associated Services are provided “as is” without warranty of any kind. Yoga Inner Peace disclaims and negates any and all warranties, expressed or implied, regarding the Website, including but not limited to, any implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
The contents, products and services on the Website are provided for informational purposes only, and are not intended to diagnose any medical condition, replace the advice of a healthcare professional, or provide any medical advice, diagnosis, or treatment. You agree that it is your responsibility to consult your physician or doctor, follow all provided safety and other instructions, and obtain authorization before accessing or using any of our Services, especially if you are prone to injuries, are pregnant or nursing, or have any other unique or special medical conditions.
You acknowledge that the teacher is not a medical professional and can only guide and inform standard yoga classes. You should fill the Health Questionaire Joining Form before you participate to any Services and notify your teacher of any health issues prior to the start of any Service.
You agree that it is your responsibility to select the Services (classes, exercises etc.) that are appropriate for someone with your level of skill and ability and you take full responsibility for how you choose to adopt this in your own practice in class. You acknowledge that certain elements of the Services (e.g. classes, sessions, workshops, retreats) can be physically demanding and you are aware of the nature of them and the associated risks involved including and not limited to physical injury. As a condition of your participation in any Services, you agree that you are physically capable of participating and accept full and complete responsibility for your own participation in them for all risks both known and unknown. You agree that should any medical or physical condition arise prior to or during a class, session, workshop and/or retreat which is likely to affect your ability to participate in it, you will not attend and will withdraw from it.
Important guidelines for live-streaming classes and/or any pre-recorded sessions/videos/tutorials: You take full responsibility to ensure a) there is sufficient space to perform the exercises safely and move freely without obstacles or obstructions, free from furniture, equipment and other hazards, b) any equipment is safe and in a suitable condition for the activity being performed, c) the surrounding floor space is entirely clear to remove any hazards that may increase the risk of slips, trips or falls, d) there are no distractions throughout the duration of the session and e) there is sufficient heating, lighting, ventilation and hydration. As with all fitness and exercise programmes, when taking part in live-streaming classes and/or using pre-recorded classes/videos you need to act with all due care to safeguard your own safety. To reduce and avoid injury, you will want to check with your doctor before beginning any Class/Service. By performing any fitness exercises without supervision, you are performing them at your own risk. You agree to take full responsibility and liability for any injury or harm or loss you sustain as a result of any live-streaming classes and/or any pre-recorded classes/videos/tutorials, DVD or information shared on our Website, Instagram Account Page, Facebook Account Page and/or YouTube Channel including emails, videos and texts.
Should you have any queries regarding our Services, please do communicate with us well in advance before signing up for any of them. Yoga Inner Peace has no responsibility in terms of booked classes that are unsuitable to you or anyone attending them.
You agree to indemnify, defend and hold harmless Evangelia Bakalakou, Yoga Inner Peace, its affiliates, its officers, its consultants and representatives, against any and all claims, suits, or actions whatsoever for liability, damages, losses, costs or compensation that may occur from your use of this Website or Services.
4.3 Personal belongings and safety in outdoors classes
You agree and acknowledge that, it is your obligation to take out personal accident and personal items insurance and that it is your responsibility to store any valuables in a safe place when attending outdoor yoga classes/sessions. Yoga Inner Peace takes no responsibility for any loss of personal belongings, before, during and after a class/session in an outdoor space, nor provide any services to protect your valuables.
4.4 COVID-19
Following the outbreak of the novel Coronavirus (COVID-19), we are doing our part to protect you, our customers, the community and our teachers. To this extent, we will be following UK government advice with regard to social distancing practices and sanitation. We ask you to disclose your health history and help us to comply with safety practices.
Symptoms of COVID-19 include but not limited to fever, fatigue, dry cough, difficulty breathing. You agree you have not, nor have, any members of your household, experienced any of the symptoms listed above within the last 14 days. You do not, nor do any members of your household, believe that they have been exposed to someone with a suspected and/or confirmed case of the Coronavirus (COVID-19). You have not, nor have any members of your household, been diagnosed with the Coronavirus (COVID-19) within the last 30 days. If any of the above apply to you, please do not request for 1-2-1 sessions or book any Service that requires to be physically present and be in close distance with other students. If any of your booked classes have been affected by this, we will try to do our best to extend these on receipt of a medical certificate which is valid based on governments guidelines.
We are following specific practices to prevent the spread of the Coronavirus (COVID-19). These include, but are not limited to, participants must comply with all social distancing guidelines, it is recommended to wear a face covering and bring your own yoga mat and props. Each participant is required to wash or disinfect their hands upon arrival. If soap and water are not available, use hand sanitizer that contains at least 60% alcohol.
We cannot be held responsible for any exposure to the Coronavirus (COVID-19) this could be caused by several factors outside of our control, we will do our best to make sure you are not exposed, but we cannot guarantee this.
You hereby release and agree to hold Yoga Inner Peace harmless from any and all causes of action, claims, demands, damages, costs, expenses and compensation or loss to yourself or others. You agree to release Yoga Inner Peace from any and all such liability for the unintentional exposure or harm due to the Coronavirus (COVID-19).
4.5 Availability of Services
We may change the schedule of classes, remove and/or add classes to the schedule we provide for various reasons. All classes are subject to availability and we may limit availability for health or operational reasons.
4.6 Livestreaming
For those attending classes via livestream, please note that other people viewing the livestream can see that you are using our service via livestream and may see your name or other personal information which is shown via the livestreaming platform you use. Yoga Inner Peace will not be held liable if other other students/participants will record the Service on their device, screenshot, share, post or otherwise do matters with the video that we cannot prevent. Yoga Inner Peace may also record the classes and share them with other customers. Please for further information read our Privacy Policy.
4.7 Purchase policy & Cancellation
Whilst every effort is made to ensure the descriptions and pictures contained within the website are a true reflection of the events, these do not form part of a contract.
Bookings are closing 30 minutes before live-streaming classes. The Zoom link will be sent out 15-30 minutes before the class. All classes will be recorded. If you reserve your spot after this time, you will only get the link from the recorded class. The link will be active for 48 hours, after that time of period it will expire and the recording will not be available any more. If you are late for class and miss the warm-up then the instructor is within their rights to refuse to allow you to join in with the class. There is no refund and/or exchange for arriving late or leaving early. Yoga Inner Peace may also record the classes and share them with other customers.
Yoga Inner Peace will not be held liable for any travelling costs, accommodation cost and any other personal cost that might arise.
You should refrain from selling our products to someone else. Yoga Inner Peace reserves the right to refuse to provide the service to anyone that is not the original customer/buyer.
Please read the cancellation policy that applies under the Livestreaming Classes, Private Classes, Workshops & Retreats stated in Clauses 6, 7, & 8.
If for any reason, any of the Services, for which you have paid for, will be cancelled by Yoga Inner Peace, either a voucher of the same value or a full refund will be provided. For any Services booked using a Gift Card a voucher of the same value will be provided, refund is non applicable in that case.
We do not accept any liability for any failure to perform or delay in performing any of our obligations under a contract between us where such failure or delay is caused by events outside our control (“Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our control and includes in particular (but without limitation) strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks, or the acts, decrees, legislation, regulations or restrictions of any government. Our performance of any contract with you is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
5.0 Our Contract
Once you have placed your order, we may send you an e-mail acknowledging receipt. Please note that this does not mean that we have accepted your order. Your order constitutes your offer to us. All orders are subject to acceptance by us and any such acceptance will be made by sending you a confirmation e-mail.
6.0 General Terms and Conditions for Online Classes
All classes must be pre-booked and must be paid in advance at the time of booking online. Passes are not transferable. Online, live-streamed classes are held via Zoom Cloud Meeting App or similar. You need a device with an internet connection to join the classes. Yoga Inner Peace does not guarantee good or adequate connection. Classes are LIVE and you may be seen or heard by other participants and teachers if you are not muted and if video is not off. Yoga Inner Peace reserves the right to remove anyone entirely or mute, without refund if deemed unsuitable, harmful to Yoga Inner Peace or to others. Please note that people attending the classes may see that you are using our service via livestream and may see your name or other personal information which is shown via the livestreaming platform you use. If you wish to cancel an online class, you should notify Yoga Inner Peace in writing by contacting sales@yogainnerpeace.com and no later than 48 hours prior to the online class start time. For cancellations prior to 48hrs, a full refund applies. Refunds are normally processed within 5-10 working days from the moment your request is acknowledged. Cancellations after this time and failure to turn up to a class without cancelling (non show) cannot be refunded or rescheduled.
7.0 General Terms and Conditions for Private Classes
Private Classes are subject to availability. If you wish to cancel a private class, you should notify Yoga Inner Peace in writing by contacting sales@yogainnerpeace.com and no later to 48 hours prior to the class start time. For cancellations prior to 48hrs, a full refund applies. Refunds are normally processed within 5-10 working days from the moment your request is acknowledged. Cancellations after this time and failure to turn up to a class without cancelling (non show) cannot be exchanged or refunded. There is no refund for arriving late or leaving early.
8.0 General Terms and Conditions for Workshops and Retreats
Workshops and Retreats subject to availability. If you wish to cancel a workshop or retreat, you should notify Yoga Inner Peace in writing by contacting sales@yogainnerpeace.com. Your cancellation fee will be determined according to the terms outlined in the chart in our agreement for the specific event. Exceptions to our cancellation policy cannot be made for ANY reason, including weather, terrorism, civil unrest, COVID-19, health changes, personal emergencies, or otherwise.
9.0 General Terms and Conditions for Gift Cards
The use of the Gift Card is subject to the Yoga Inner Peace (www.yogainnerpeace.com) Terms & Conditions at the time of the purchase. Purchase and/or use of the Gift Card constitutes your acceptance of it.
Gift cards expire 6 months from the date of purchase and they can be used for any available running service. Gift cards are non-transferable and non-refundable and must be used only by the gift card receiver named at the time of the purchase.
To redeem a gift card you must visit www.yogainnerpeace.com and select one or more of the available running services on the particular announced dates and timeslots. Gift cards can be offered only in a digital/electronic format and they will be sent to the receiver’s email address stated in the individual order. The gift card purchaser is responsible to enter the correct and complete receiver’s contact details during the purchase. Yoga Inner Peace has no responsibility for any errors/omissions on the receiver’s personal & contact details nor the message sent.
Regardless the value of the gift card, you are more than welcome to book any class/service you’d like and should the price of the later be higher than the total value of the gift card an additional payment to cover the remaining amount of money will be required.
To participate in any classes/services the gift card receiver must be over eighteen years of age and to acknowledge and accept that may involve some personal risk. A Health Questionnaire Joining Form/Disclaimer is required to be filled by the gift card receiver prior to any class/service participation. By selecting to participate in any classes/services you agree you are physically capable of participating and accept full and complete responsibility for your own participation in them for all risks both known and unknown. You agree that it is your responsibility to consult your physician or doctor, follow all provided safety and other instructions, and obtain authorization before accessing or using any of our products or services, especially if you are prone to injuries, are pregnant or nursing, or have any other unique or special medical conditions. You agree that should any medical or physical condition arise prior to or during a class, session, workshop and/or retreat which is likely to affect your ability to participate in it, you will not attend and will withdraw from it. Yoga Inner Peace has no obligation to evaluate or ensure and/or develop the level of your physical capability in order to be able to participate to the services.
If you wish to cancel an live-streaming class/service purchased using a gift card, you should notify Yoga Inner Peace in writing by contacting sales@yogainnerpeace.com and no later to 48 hours prior to the online class/service start time. For cancellations prior to 48hrs, the class/service can be exchanged for another class/service up to the same value, however, if you desire to exchange it with a class/service of a higher value, you are more than welcome to do so upon additional payment made to cover the difference in price. Cancellations after this time and failure to turn up to a class without cancelling (non show) cannot be exchanged or being refunded.
If you wish to cancel a non-online service (e.g. workshop, retreat etc), please read Clause 8.
Please note that the gift cards can only be used for full price services. Promotional/special offer classes/services are excluded. A gift card will be deemed invalid if it is out of date (the expiry date is clearly stated on the voucher). If you need some extra time to book your gift card, we offer easy extensions upon providing us with a valid reason for the request. Yoga Inner Peace will evaluate your request as soon as possible and we will try our best to allow for the extension without any obligation to do so. Please note that to request an extension, you should notify Yoga Inner Peace in writing by contacting sales@yogainnerpeace.com at least 2 weeks prior to the expiry date.
Your privacy is our highest priority. Please review our Privacy Policy carefully. By using our Website, you consent to such processing and you warrant that all data provided by you is accurate.
10.0 Price and Payment
The price of any Services will be as quoted on the Website from time to time in pounds sterling (£), except in cases of obvious error where we will not be bound by the erroneous price. The price must be paid prior to any order being finalised. The prices quoted are inclusive of VAT (if VAT is applicable). We only accept card payments. Yoga Inner Peace is not responsible for any fees, charges or exchange rates levied by individual financial institutions or card issuing companies that are the responsibility of the payer.
11.0 Applicable Law & Jurisdiction
These terms & conditions and any non-contractual obligations will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
If, for whatever reason, a court of competent jurisdiction finds any term or condition in these Terms & Conditions to be unenforceable, all other terms & conditions will remain unaffected and in full force and effect. No waiver of any breach of any provision of these Terms & Conditions shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.
12.0 International Use
We make no promise that materials on the Website are appropriate or available for use in locations outside the United Kingdom, and accessing the Website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this Website from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
13.0 Cease of Operations/Services
Without prejudice to any other rights or remedies which we may have, in case Yoga Inner Peace cease its operations, we have no liability to you (and without any obligations to you regardless of whether they existed before) nor we are liable to refund any monies for booked classes/services and gift card balances.
14.0 Miscellaneous
You may not transfer any of your rights under these Terms & Conditions to any other person. We may transfer our rights under these Terms & Conditions to another business where we reasonably believe your rights will not be affected.
If you breach these Terms & Conditions and Yoga Inner Peace chooses to ignore this, Yoga Inner Peace will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms & Conditions.
15.0 Privacy Policy
Your privacy is very important to us. Accordingly, we have developed a Privacy Policy for you to understand how we collect, use, communicate and disclose and make use of personal information. Please review our Privacy Policy carefully. By using our Website, you consent to such processing and you warrant that all data provided by you is accurate.
YOU HEREBY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING AGREEMENT, AND THAT BY USING THE SERVICE OR ACCESSING THE WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS & CONDITIONS SET FORTH HEREIN.
